Quick answer
Return to work the day after leave ends: a 26-week leave starting 1 January 2027 ends 1 July 2027, so the first day back is 2 July 2027. A 12-week leave starting 1 March 2027 ends 23 May 2027, returning 24 May 2027. Plan the handover before leave starts, not during it.
The three dates that matter
First, the return date: the day after the last leave day. It is easy to get wrong by one day, and one day matters for payroll and for the first day back. Second, the handover window: the last two to three weeks before leave starts, when work is transferred, documents are updated and the cover arrangement is tested. Third, the check-in date: a brief contact during leave, agreed in advance, so the return is not the first conversation in months.
Write all three down and share them with the manager and the cover. A date that exists only in one person’s head does not exist.
Handover — before leave starts, so cover is real
Leave — the statutory weeks, uninterrupted
Check-in — agreed in advance, not a drip of work
Return week — ramp back, don’t restart
The handover, done properly
A good handover has three parts: a written list of live work with owners and deadlines, access to the systems and documents the cover will need, and a named contact for decisions the cover cannot make. Anything that depends on one person’s memory should be written down before leave starts.
The most common failure is the opposite: a handover that starts in the final week, when energy is lowest and the cover has no time to ask questions. Start it at least three weeks before the leave date, and test it — have the cover run a day independently before you go.

The first week back
Plan the first week as a ramp, not a restart: meetings to catch up, not decisions to make on day one; the cover’s notes read before the inbox is opened; and the working pattern — hours, location, nursing breaks — agreed in advance rather than negotiated under pressure.
The Act provides for nursing breaks — two a day until the child is about 15 months old, in addition to the regular rest intervals. Where the establishment has 50 or more employees, a crèche facility is also required, with permitted visits during the day. These are entitlements, not favours, and they should be part of the return plan.
Work from home after leave
After maternity leave, a woman in a job where the nature of work permits can agree with her employer to work from home, on mutually agreed conditions. It is an agreement, not an automatic right — but it is a statutory possibility worth raising explicitly, with the pattern (days, hours, review date) written down rather than left vague.
Rights that protect the return
Dismissal during maternity leave is prohibited, and discharge or dismissal on account of pregnancy is unlawful. On return, the woman is entitled to her original position or an equivalent one. If the role has genuinely changed, that needs a lawful basis — not the leave itself.
Non-compliance is not a minor matter: failure to pay maternity benefit or denying entitled leave can attract imprisonment of up to one year, a fine, or both. If a return is refused or the role is downgraded, the first step is a written record of what was said and when, followed by the employer’s grievance route and, if needed, the Inspector appointed under the Act.
Return checklist
Return date confirmed in writing; handover document complete and tested; cover’s contact and decision authority named; nursing-break pattern agreed; crèche access confirmed where applicable; work-from-home pattern agreed where applicable; first-week meetings scheduled as catch-ups, not decisions; payroll confirmed for the return month.
Common mistakes to avoid
Getting the return date wrong by one day; leaving the handover to the final week; agreeing no check-in during leave; treating nursing breaks and crèche provision as negotiable; and accepting a role change without asking for its basis in writing.

Frequently asked questions
What is the first day back after maternity leave?
The day after the last leave day: a 26-week leave starting 1 January 2027 ends 1 July 2027, so the return date is 2 July 2027.
How early should a handover start?
At least three weeks before leave starts, with a written list of live work, system access and a named decision contact — and a test day where the cover runs things independently.
Are nursing breaks an entitlement?
Yes. Two nursing breaks a day until the child is about 15 months old, in addition to regular rest intervals.
Is a crèche required?
In establishments with 50 or more employees, the Act requires a crèche facility, with permitted visits during the day.
Can I work from home after maternity leave?
By agreement with the employer, where the nature of work permits, on mutually agreed conditions.
Can an employer dismiss a woman during maternity leave?
No. Dismissal during maternity leave, and dismissal on account of pregnancy, are prohibited — with penalties including imprisonment up to one year and fines.
Must the same job be available on return?
The woman is entitled to her original position or an equivalent one; a genuine role change needs a lawful basis.
What if my role was downgraded on return?
Record what was said and when in writing, use the employer’s grievance route, and if needed approach the Inspector appointed under the Act.
Should I stay in contact during leave?
A brief check-in, agreed in advance, keeps the return from being the first conversation in months — but it should be agreed, not imposed.
What should the first week back look like?
A ramp: catch-up meetings, the cover’s notes read before the inbox, and the working pattern already agreed — not decisions on day one.
